Los Estados confederados proyectan la existencia de un doble sistema normativo: federal y local. Esto provoca el surgimiento de colisiones y contradicciones entre ambos sistemas, lo que se pensaría debería ser resuelto por el derecho internacional, atendiendo el principio de subsidiariedad, no obstante, esto no siempre es así, ya sea porque el derecho internacional no regule ese caso concreto o bien, porque el Estado en cuestión no haya otorgado su consentimiento y la respuesta no le sea vinculante. Estas reflexiones invitan (...) a contrastar la naturaleza de las normas del derecho local y del derecho internacional, pues mientras que las primeras son asociativas, dado que no necesariamente requieren ser consentidas para ser vinculantes, las segundas, aparentemente, sí requieren el consentimiento de los Estados para que tengan efectos vinculantes. En este artículo pretendemos postular una posible solución al problema del conflicto entre los distintos órdenes normativos, partiendo desde una postura cuasi-voluntarista. Las obligaciones cuasi-voluntarias son aquellas que no surgen del consentimiento, pero tampoco completamente de los roles que tienen los Estados en el sistema internacional. Estas obligaciones nacen en el núcleo de grupos dominantes, a los que llamaremos grupos autocontenidos en el ámbito internacional, que tienen como rol la creación y socialización de las normas y obligaciones de derecho internacional, logrando que los otros grupos simplemente las sigan como si tuvieran un deber de hacerlo. Para ello, servirá como referencia el análisis del caso de las disimiles normas migratorias entre California y Texas dentro de Estados Unidos. (shrink)

Background: Serious games have shown positive results in increasing motivation, adherence to treatment and strengthening the therapeutic alliance in multiple psychiatric disorders. In particular, patients with impulse control disorders and other disorders in which the patient suffers from inhibitory control deficits have been shown to benefit from serious games.Aim: The aim of this study was to describe the characteristics and to evaluate the usability of a new serious videogame, e-Estesia. This serious videogame was designed to improve emotion regulation in patients (...) with gambling disorder. Preliminary results from a pilot sample are also reported.Method: A pilot sample of 26 patients undergoing treatment for GD was recruited. Participants used e-Estesia on a tablet, which was connected to a thoracic band that sent heart rate and heart rate variability data to the videogame platform in order to provide biofeedback. The System Usability Scale was completed by patients to determine the usability of e-Estesia.Results and Discussion: e-Estesia performed comparatively well for all the explored groups. Around 84.6% of the patients endorsed that it was easy to use. Female patients with GD presented higher HRV during the use of the serious videogame compared to men. (shrink)

Este artigo apresenta uma reflexão sobre o processo de implementação de políticas públicas na área da educação nos municípios de Rio Pardo, Venâncio Aires e Santa Cruz do Sul, localizados no interior do Rio Grande do Sul/Brasil. O objetivo do artigo foi analisar como os burocratas de nível de rua influenciam na área da educação em processos includentes e/ou excludentes que afetem a (re)produção ou redução de desigualdades no processo de implementação de políticas públicas. O artigo Burocracia e Implementação de (...) Políticas Públicas: Desafios e Potencialidades para Redução de Desigualdades, de autoria de Gabriela Lotta (2021), foi a base para os dois momentos, tanto o teórico como a pesquisa de campo. Na pesquisa de campo foram realizadas três entrevistas semiestruturadas aprofundadas com profissionais da área da educação. Após a análise dos resultados, considera-se que a implementação bem-sucedida das políticas públicas deve considerar as avaliações de impacto social que analisem de maneira abrangente como a política afeta as desigualdades. A ausência desse tipo de avaliação pode limitar a compreensão dos resultados e impedir ajustes necessários. (shrink)

How do scientists and theologians conceive new ways of mapping the world? Can parallels be found between the images they use, or the models they offer when new questions arise? I will explore Albert Einstein’s views on scientific imagination with the goal of contributing – at least within his own perspective – to answering these questions. Drawing on McGrath, I will first briefly describe Einstein’s desire for a unified vision of reality, the links between science and a ‘cosmic religion’, and (...) his overall ideas on transcendence. I will later further develop Einstein’s fundamental features of a cosmovision that grounds his work in physics, and encompasses his philosophical views on human existence and his general way of seeing the world. I will focus on Ideas and Opinions (1982), which will allow me to set the broad picture of his theory of everything and, at the same time, bring up the central aspects of Einstein’s ideas on the scientific imagination. Finally, I will briefly summarise my conclusions concerning Einstein’s views on the nature of scientific imagination as a mental device, especially regarding its twofold role in what I call ‘visual image play’ and conceptualization. In this text, we ask if analogy can enable a dialogue between religion and the social sciences. To do so, we focus in the conflict between the biblical understanding of man as a created being and the notion of human nature as a social construct. Although there seems to be a fundamental dispute in social constructivism between nature and freedom (Ian Hacking), we consider analogical reasoning (Mauricio Beuchot) enables anthropological views, like Philip Hefner’s, that include central aspects of the doctrine (...) of creation and understand nature and freedom as complementary human features, thus allowing the desired dialogue. The family of discounted Shapley values is analyzed for cooperative games in coalitional form. We consider the bargaining protocol of the alternating random proposer introduced in Hart and Mas-Colell. We demonstrate that the discounted Shapley values arise as the expected payoffs associated with the bargaining equilibria when a time discount factor is considered. In a second model, we replace the time cost with the probability that the game ends without agreements. Reponse to Peter Milne (2005)'s argument agaist maximalism about truthmaking.

The origin of chordates and the consequent genesis of vertebrates were major events in natural history. The amphioxus (lancelet) is now recognised as the closest extant relative to the stem chordate and is the only living invertebrate that retains a vertebrate‐like development and body plan through its lifespan, despite more than 500 million years of independent evolution from the stem vertebrate. The inspiring data coming from its recently sequenced genome confirms that amphioxus has a prototypical chordate genome with respect to (...) gene content and structure, and even chromosomal organisation. Pushed by joint efforts of amphioxus researchers, amphioxus is now entering a new era, namely its maturation as a laboratory model, through the availability of a large amount of molecular data and the advent of experimental manipulation of the embryo. These two facts may well serve to illuminate the hidden secrets of the genetic changes that generated, among other vertebrates, ourselves. (shrink)

Reseña de Colapietro, Vincent M. Acción, sociabilidad y drama. Un retrato pragmatista del animal humano, La Plata, Edulp, 2020, 222 páginas.

El presente artículo indaga si ¿es el sujeto un ser autónomo en la deliberación política o sonlos pensamientos, las posturas y las formas de la organización política mediadas por las distintas herramientas comunicacionales a las que se ve expuesto quienes lo determinan? Así, analiza larelación que existe entre mass media y política, con la capacidad deliberativa del individuo altomar decisiones en el contexto político, a partir de Chomsky y Han. La metodología es cualitativa con diseño documental, el instrumento son fichas (...) bibliográficas aplicadas a fuentes primarias y secundarias. Se usan bases de datos con el algoritmo: “Neoliberalismo, psicopolítica, big data, medios de comunicación de masas y democracia”. Se analizan 13 libros y 20 artículos. Se identifican las nuevas formas y herramientas de organización política y la relación entre política y medios de comunicación. Se concluye que: 1) el neoliberalismo direcciona la idea de libre mercado hacia el individuo mismo, 2) es necesaria una ciudadanía crítica que tenga un rol más activo en lademocracia, 3) se identifica a la psicopolítica como una nueva forma de organización política, 4) lanueva herramienta de la política es el big data, 5) se evidencia que la relación entre política y massmedia está vinculada con los grupos de poder y 6) la emocionalización de la comunicación políticadisminuye la autonomía individual. This article consists of an analysis of the influence of the Berlin philosopher Georg Simmel on the initial stages of José Ortega y Gasset's philosophy. In this case, we will focus on the influence that Simmel's aesthetics exerted on the young Ortega for the configuration of a theory of the historical evolution of the arts in which some of the strong theses that would characterize his mature thought are revealed. It should be noted that this article is included within a (...) project of analysis of the relationship of influence between Simmel and Ortega, an influence that covers multiple fields of philosophical and scientific thought, such as epistemology, aesthetics, ontology, sociology, etc., as well as diverse and interesting contents of analysis. The main objective is to demonstrate that under the fundamental ideas of Ortega y Gasset's philosophy of historical and vital reason flows the tension between life and form that is the basis of Simmelian thought. The objective of this work is to show that the cognitive and ontological connections between Benjamin’s and Zambrano’s works, more than similarities and differences, are based on the exercise of their expressive action. Along with the image that appears in the writing, both thinkers cite old poetic forms, which allows them to update philosophical, political and theological figurations to configure an experience of thinking in work.

The concept of well-being of rural families is part of a theory under construction in which new theoretical elements are constantly being incorporated. This research aims to determine the influence of farmers’ knowledge on the well‑being of cocoa growing families in the departments of Santander, Huila, Meta and Caquetá, Colombia. Four categories of farmers were identified with different levels of knowledge in the management of cocoa cultivation obtained through a cluster analysis. The well-being of cocoa farmers, understood as the balance (...) in the capital endowment of rural households, was obtained through the application of a semi-structured interview with 49 variables of human, cultural, social, political, natural, built, and financial capitals. The results show that cocoa knowledge is heterogeneous in the study area, with a slight improvement towards harvesting, post-harvest and transformation links. There is a positive relationship between cocoa knowledge and the well-being of cocoa farming families. Thus, producers with greater integral knowledge, with emphasis on post-harvest and bean transformation links, showed greater well-being. The Random Forest analysis identified that human capital (political, social, human, and cultural) made the greatest contribution to well-being. The findings show that cocoa knowledge contributes to the well-being of rural households to the extent that it favors vertical relationships (linkages with local governments) and horizontal relationships of producers (participation of association managers, sharing knowledge with friends, neighbors and partners, and cocoa training). El objetivo del presente trabajo es mostrar que las conexiones cognoscitivas y ontológicas entre Benjamin y Zambrano, más que simples similitudes y diferencias, se fundamentan en el ejercicio mismo de su acción expresiva. Junto a la imagen que brinca en la escritura, ambos pensadores citan viejas formas poéticas, permitiéndoles actualizar figuraciones filosóficas, políticas y teológicas para configurar una experiencia del pensar en obra.

En Das Passagen-Werk Benjamin vuelve sobre el concepto de Ursprung, esta vez como salto genuino de lo que ha sido, como vuelco dialéctico en el instante del Jetztzeit del materialista histórico, instante de legibilidad, pero también como parada e interrupción [Stillstand] de este despliegue, donde la fuerza dialéctica queda suspendida por un instante, en el ahora de su cognoscibilidad. Para llegar a esto, el berlinés ha hecho un recorrido reflexivo, crítico y contundente, el cual comienza a definirse más intensamente desde (...) el prólogo Epistemocrítico de su Trauerspiel. This research aims to describe how practicing lawyers perceive ‘plain writing’ in the legal field and to conceptualize this notion through the discourse analysis of these specialists. To do so, a qualitative research framed in the interpretive paradigm has been developed. Specifically, 18 practicing lawyers, from different countries and with different specializations in the practicing of Law, were surveyed. After analyzing the discourse of the interviewed lawyers, eight macro categories accounting for plain language both generally and particularly were identified. The (...) audience was identified as a key element in the production of legal texts which facilitate justice to citizens. Based on our analysis, we conclude with a definition of plain writing. El artículo consiste en el estudio comparado de la ontología de Georg Simmel y de José Ortega y Gasset, con dos objetivos: demostrar la influencia de Simmel en la filosofía de Ortega, y exponer su ontología «comparada» como una crítica a la tradición parmenídea del ser. Para ello planteamos dos tesis de partida. La primera tiene que ver con el carácter vitalista de la filosofía de nuestros dos autores. En segundo lugar, la tesis de la «intradición de la tradición» como (...) mecanismo para estudiar la forma en que Simmel y Ortega recogen la tradición críticamente, a efecto de ajustarla a la «altura de su tiempo», según la terminología orteguiana. Finalmente, concluiremos con la idea de que la ontología de Simmel y Ortega es una crítica a la epistemología o a las implicaciones ontológicas de la epistemología moderna. (shrink)

El objetivo de este ensayo es exponer la experiencia del pensar en obra, propia de una escritura filosófica que asume la singularidad de la configuración literaria en su más originario significado, como palabra memorable que testifica dicha experiencia, asumiéndola como problema del conocimiento. Intentaremos exponer este gesto que unifica diversas construcciones filosóficas que se han caracterizado por ofrecer un tramo de pensamiento en medio de la acción escritural, como punto de vista posible, como vía de acceso al recorrido de un (...) problema. Asumiendo que los límites entre filosofía y literatura se difuminan en una prosa que se deja guiar por la experiencia formativa –Bildung–nos inmiscuimos en la actualización de Miguel Morey desde el uso singular de la caja de herramientas de Nietzsche, junto a la compañía poética y filosófica de María Zambrano y Walter Benjamin. A diferencia de la filosofía ambiental colombiana, que alcanza un cierto grado de unidad debido a la influencia de la obra de Augusto Ángel-Maya, la filosofía ambiental argentina es más diversa en su panorama de puntos de vista y enfoques. A pesar de que no podría afirmarse que constituyen una filosofía ambiental propiamente tal, los escritos de Rodolfo Kusch podrían hacer una contribución significativa a un pensamiento ambiental anclado en las peculiaridades de nuestra cultura. Alicia Irene Bugallo ha trabajado en (...) temas de ecofilosofía, y ha introducido estos temas a jóvenes, educadores y el público en general. Alcira Bonilla ha introducido un tipo de eco-humanismo ético, que se mueve lejos del antropocentrismo a la vez que evita un fisiocentrismo o sacralización de la naturaleza. A diferencia de Bugallo y Bonilla, cuyas posiciones se acercan a la ecología profunda, María Julia Bertomeu ha enfatizado la necesidad de una clarificación normativa de reglas generalizables orientadas hacia la protección medioambiental. La Escuela Marina Vilte de la Confederación deTrabajadores de la Educación de la República Argentina ha sido un auténtico catalizador formando una nueva generación de educadores con un enfoque en temas ambientales. Un grupo de colaboración de intelectuales que trabaja en pensamiento crítico, encabezado por su coordinador Guido Galafassi, ha creado la revista Theomai y elaborado una crítica de nuestra actual situación socio-ambiental. En cuanto a nuestros medios de comunicación de masas, durante varias décadas Miguel Grinberg y Antonio Brailovsky han sido figuras inspiradoras que han difundido los temas ambientales. (shrink)

Pegaso Zorokin es una novela experimental que fue publicada en 2012 en cinco volúmenes de la revista digital [Radiador] Magazine. Está compuesta por veintitrés capítulos sin aparente conexión entre ellos. Esta estructura complica una lectura global y pone en crisis la idea de novela. Sin embargo, es posible encontrar continuidad dentro de los fragmentos si se atiende a los puentes hipertextuales dentro del texto. Estas conexiones logran la unidad buscada. La conformación de la novela es muy similar a la de (...) cualquier red social digital. El objetivo de este artículo es explicar este funcionamiento dinámico. El trabajo analítico fue realizado bajo un método semiótico que involucra los conceptos semiósfera y persona semiótica de Yuri Lotman; hipertextualidad de Gerard Genette y propagabilidad de Gabrielle Marino. El análisis fue aplicado a tres de las cinco entregas de la novela de Arana, demostrando que el texto está compuesto por una red interna cohesionadora. (shrink)

En primer lugar, se establecen las «bases objetivas» para fundar una influencia real de Simmel sobre Ortega, no inspirada en un simple «aire de familia». En los últimos años se está produciendo una importante recuperación del pensamiento de Georg Simmel. Dicha importancia no radica sólo en el valor de Simmel como clásico de la filosofía, sino también en la imperiosa actualidad de sus teorías e ideas filosóficas y sociológicas. A estos esfuerzos de actualización del pensamiento simmeliano quiero sumar un estudio de las principales ideas de su antropología filosófica. El hecho de que podamos tomar su antropología como una síntesis y modernización de la tesis marxistas (...) y nietzscheanas es una evidencia de la importancia que pueden tener las ideas de Simmel hoy día. Por lo tanto, el objetivo de este artículo es el de presentar las principales ideas de la antropología filosófica de Georg Simmel para, a partir de ellas, confeccionar un cuadro general de la estructura anímica del individuo moderno. The main object of the article is the exposition of the critical theory of culture of Georg Simmel, which we can call «tragedy of modern culture». In connection with this exhibition, whose topicality we do not doubt since the social and cultural problems that to a large extent are still suffered in large cities are being brought to the table, we present Simmel’s idea of culture as a condensation of the idea of culture developed by German idealism. On the other (...) hand, and as a second objective, we will try to demonstrate the line of continuity that exists between Simmel and the critical theory of the Frankfurt School with respect to the criticism of modern culture. The Hoffmann reflex (H-wave) is produced by alpha-motoneuron activation in the spinal cord. A feature of this electromyography response is that it exhibits fluctuations in amplitude even during repetitive stimulation with the same intensity of current. We herein explore the hypothesis that physical training induces plastic changes in the motor system. Such changes are evaluated with the fractal dimension (FD) analysis of the H-wave amplitude-fluctuations (H-wave FD) and the cross-covariance (CCV) between the bilateral H-wave amplitudes. The aim of this study (...) was to compare the H-wave FD as well as the CCV before and after track training in sedentary individuals and athletes. The training modality in all subjects consisted of running three times per week (for 13 weeks) in a concrete road of 5 km. Given the different physical condition of sedentary vs. athletes, the running time between sedentary and athletes was different. After training, the FD was significantly increased in sedentary individuals but significantly reduced in athletes, although there were no changes in spinal excitability in either group of subjects. Moreover, the CCV between bilateral H-waves exhibited a significant increase in athletes but not in sedentary individuals. These differential changes in the FD and CCV indicate that the plastic changes in the complexity of the H-wave amplitude fluctuations as well as the synaptic inputs to the Ia-motoneuron systems of both legs were correlated to the previous fitness history of the subjects. Furthermore, these findings demonstrate that the FD and CCV can be employed as indexes to study plastic changes in the human motor system. (shrink)

The question I address in this paper is whether and under what conditions it is morally right to bring a person into existence. I defend the commonsensical thesis that, other things being equal, it is morally wrong to create a person who will be below some threshold of quality of life, even if the life of this potential person, once created, will nevertheless be worth living. However commonsensical this view might seem, it has shown to be problematic because of the (...) so-called 'Non-Identity Problem'. Both utilitarian and rights-based approaches have been unable to provide a solution to this problem. I rest my thesis on two premises: that causing a disability or impairment in a future person is prima facie wrong, so long as we can avoid causing such a disability to that very person; and that reproduction, under normal conditions, is prima facie morally indifferent. From these two premises, I conclude that it is prima facie wrong to bring into existence a person with a non-trivial disability or impairment (which might be, nonetheless, compatible with a worthwhile life), even if the only available alternative is to remain childless. Milne [2005] argued that a sentence saying of itself that it does not have a truthmaker is true but does not have a truthmaker. López de Sa and Zardini [2006] worried that, by parity of reasoning, one should conclude that a sentence saying of itself that it is not both true and short is true but not short. Recently, Milne [2013] and Gołosz [2015] have replied to López de Sa and Zardini’s worry, arguing in different ways that the (...) worry is illfounded. In this paper, I’ll address these replies and argue that they fail to dispel López de Sa and Zardini’s worry, bringing out in the process some broader points concerning the use of self-referential sentences in arguments in philosophy of logic. Introducción: El examen estatal escrito evalúa la competencia del egresado y debe cumplir los requisitos de su confección y de su análisis informar las deficiencias en el proceso docente educativo para su perfeccionamiento. Objetivo: Caracterizar el examen estatal ordinario escrito y los resultados obtenidos en la Facultad de Estomatología. Camagüey durante el período 2011-2012. Métodos: Se realizó un estudio descriptivo del examen estatal ordinario escrito aplicado a 146 estudiantes. Se elaboró una base de datos con las calificaciones obtenidas, índice académico (...) y una guía con las variables tipo de examen, de preguntas, nivel de asimilación, claridad de formulación, correspondencia con los objetivos de la carrera, clave de calificación y cumplimiento de los criterios de Guilbert, analizados por grupo de expertos. Resultados: En los resultados se aproximó la nota de los excelentes (27,4 %) con el índice académico de los altos rendimientos (28,1 %). La mediana general fue de 86,3. Los temas más explorados fueron Endodoncia (18,8 %), Prótesis y Odontopediatría (10,4 %). Las preguntas con más valor fueron de temas curativos. El nivel de asimilación fue reproductivo y el 35,4 % de preguntas tipo selección múltiple complemento agrupado. Existieron dificultades de diseño del examen y autopreparación de los estudiantes. Conclusiones: Los resultados se aproximaron a los rendimientos académicos. No hubo equidad entre el número, valor de las preguntas por temas y nivel de asimilación. Los errores se asociaron en frecuencia al diseño y redacción de algunas preguntas, insuficiente estudio y en menor grado a la falta de sistematicidad en el proceso docente, que permitieron determinar las deficiencias para su intervención. Introduction: The State written exam evaluates the competence of seniors and must meet the requirements of its preparation and analysis in order to report deficiencies in the educational teaching process for its further development. Objective: To characterize the written regular state exam and the results obtained at the Faculty of Stomatology. Camaguey during the period of 2011-2012. Methods: A descriptive study of the written regular state exam was conducted to 146 students. A data base was developed with the grades obtained, academic index and a guide with the exam- type variables, questions, level of assimilation, clarity of formulation, correspondence with the objectives of the career, key qualification and compliance with the criteria of Guilbert, all analyzed by groups of experts. Results: In the results the excellent notes (27.4%) approached to the academic index of high yield (28.1%). The general average was 86,3. The most explored themes were Endodontics (18.8%), Prosthesis and Pediatric Odontology (10.4%). healing topics were the questions with more value. The level of assimilation was reproductive and 35.4% of multiple choice type questions complement clustered. There were difficulties according to the test design and the students' self study. Conclusions: The results were close to academic performance. There was no equality between the number, value of the questions by topic and level of assimilation. Errors were often associated with the design and wording of some questions, insufficient study and in a lesser extent to the lack of systematic fashion in the teaching process, which allowed to determine deficiencies for its intervention. In western cultures, when it comes to places of worship and liturgies, music, acoustics and architecture go hand in hand. In the present study, we aimed to investigate whether the emotions evoked by music are enhanced by the acoustics of the space where the music was composed to be played on. We explored whether the emotional responses of western naïve listeners to two vocal pieces from the Renaissance, one liturgical and one secular, convolved with the impulse responses of four Christian (...) temples from the United Kingdom, were modulated by the appropriate piece/space matching. In an alternative forced choice task where participants had to indicate their preference for the original recording of the piece (not convolved with any temple-like acoustics) vs. the convolved one, no significant differences were found. However, in the tasks where participants rated their emotional in response to each piece and acoustic condition, the factorial ANCOVA analyses performed on the results revealed significant effects. We observed that, across pieces and spaces, participants found the temple-like acoustics as more transcendent, compared to the acoustics of the original version of the pieces. In addition, they rated the secular piece as more tender and the liturgical piece as more expressive in its original versions, compared to the convolved ones. We conclude that the acoustic signature of the four Christian temples causes an exaltation of certain emotions on listeners, although this effect is not associated to one or another musical piece.
